Terms of Service

These terms are between On Premise Sports LLC (“we,” “us”) and the bar, restaurant, or other business that signs up for Fantasy Draught (“you”). Fantasy Draught is a service for businesses. By starting a free trial or paying for the service, you agree to these terms.

1. What Fantasy Draught is

Fantasy Draught lets your guests scan a QR code at their table, join a live professional or college football game, and earn rewards that you choose. You get an admin dashboard to set up rewards, activate games, redeem rewards, and see how it’s going. Guests don’t pay to play and don’t wager money through the service.

We may improve, change, or remove features over time. We aim to keep the service running on game days, but we don’t promise it will always be available or error-free. Game information and live stats come from third-party data sources and can be delayed, incomplete, or wrong; we aren’t responsible for that.

2. Your free trial and billing

• Free trial. Your first 14 days are free. We ask for a payment card to start the trial.
• Price. After the trial, the service costs $150 per week, plus any sales tax that applies where your venue is located. Your card is charged automatically each week, and the subscription renews every week until it ends under section 3.
• Payments. Payments are handled by our payment processor, Stripe. We don’t see or store your full card number.
• Failed payments. If a payment fails, your access is paused until the card is fixed or another payment goes through.
• Price changes. We may change the price. We’ll give you at least 30 days’ notice by email, and the new price applies to later billing periods.

3. Ending your subscription

• During the free trial, you can end the subscription at any time before the trial ends by emailing getinthegame@onpremisesports.com. You won’t be charged.
• After the trial, you can end the subscription by emailing us at the same address. It ends at the close of the weekly billing period you’re in. We don’t refund or credit a week that has already been billed.
• We cancel on request and confirm by email. There is no self-service cancel button, so email us to end it.

We can also end or suspend your service: right away if you don’t pay, break these terms, or misuse the service, and otherwise on 7 days’ notice. We can decline or end service to any venue for any reason, including location.

4. You’re in charge of your rewards and your venue

You decide which rewards to offer, what they cost you, and who can redeem them. You’re responsible for honoring the rewards you offer and for how you run the program at your venue, including following the laws that apply to you about alcohol service, promotions, and giveaways. Your staff confirms each redemption. We don’t provide legal advice, and nothing here is a promise that any particular reward or promotion is lawful where you operate.

5. Guest information

To play, guests give a phone number (to receive a one-time text code) and a display name. We use this information to run the service and we don’t sell it. See our Privacy Policy for details. Your dashboard shows activity and totals for your venue; you agree to use guest information only to run your program at your venue and not to misuse it.

6. Our names and no league affiliation

“Fantasy Draught” and “On Premise Sports” belong to us. Fantasy Draught is not affiliated with, endorsed by, or sponsored by any professional or college football league, association, or team.

7. Limits on our responsibility

The service is provided “as is.” To the fullest extent the law allows, we’re not liable for indirect or consequential losses, such as lost sales, lost profits, or the cost of rewards you give out. Our total liability to you for anything related to the service is limited to the amount you paid us in the 3 months before the claim.

8. Other terms

• Changes. We may update these terms. We’ll give you notice by email for material changes; continuing to use the service after the effective date means you accept them.
• Governing law. These terms are governed by the laws of the State of Wisconsin, and disputes will be handled in the state or federal courts located in Waukesha County, Wisconsin.
• The whole agreement. These terms are the entire agreement between us about the service.
